1. Who you are agreeing with

Mozey is published by Goodweather Labs LLC ("Mozey", "we", "us"), a California limited liability company at 2108 N St, Ste N, Sacramento, CA 95816, United States.

By creating an account or using the app, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use Mozey.


2. Who may use Mozey


3. Your account

You are responsible for what happens under your account and for keeping access to your email secure, since signing in uses that email and an emailed link is enough to get in. Tell us promptly if you believe someone else has gained access.

You can delete your account at any time from Settings. Deletion removes your account details, your private lists, your Soles history and the things you wrote, and strips your identity from the game records that remain, including the day-by-day step figures inside those records, which stay as part of games other people played. Those records are de-identified, not anonymous. They stay attached to an account with no name, handle or picture, because deleting them would rewrite other players' record of games they played. The Privacy Policy sets out exactly what goes and what stays.


4. Steps and health data

Mozey reads your daily step total from Apple Health or Health Connect with your permission, and may also use a second motion permission, "Motion & Fitness" on iOS and "Physical activity" on Android, to show your count updating live. That live number is used on your device, and is also sent to us when you claim your daily Shoebox so the reward matches the number you were shown. You can revoke either permission at any time in your device settings; Mozey keeps working, but step-based features stop updating.

Mozey is not a medical device and is not medical advice. Step counts come from your device and its sensors and can be inaccurate, delayed, or missing. Do not rely on Mozey for any health, fitness, or medical decision, and talk to a qualified professional before starting or changing any exercise routine.

Walk safely. Pay attention to your surroundings. Do not use the app while driving, and do not put yourself in danger to win a game or keep a streak.


5. Games, friends, and content you post

Games are played with people you choose, and your comments are visible only to the people in that game. Several other things travel further, by design.

Seasons. While you are in Seasons, which is on by default and turned off by the "Seasons & leaderboard" switch in Settings, your display name, handle, avatar and step totals are visible to other Mozey players who are not your friends, on two surfaces: the worldwide steps board, and the roughly thirty-player monthly league you are placed in. That one switch covers both surfaces: with it off you appear on neither, and the Season tab is hidden.

Your results. Unless you turn off "Show my game activity to friends" in Settings, your friends can see that you won a game or opened a vault even if they were not in it, along with the game and when it ended, never your step counts. Separately, when a game ends, the players in it are shown a celebration that your friends can also see.

Search. Your exact @handle is always findable by search. That is how friends add you, and it cannot be switched off. What you can switch off, in Settings → Privacy → "Findable by name", is being found by your display name or by a partial handle.

Mutual friends. Mozey may show another player which of their friends are also friends with you, including those friends' names, handles and avatars. This works between any two adult accounts, whether or not you are friends, and is suppressed entirely when either account is under 18 or either person has blocked the other.

You are responsible for what you post: your display name, handle, comments, and reactions. Do not post anything unlawful, harassing, hateful, sexual, threatening, deceptive, or that infringes someone else's rights, and do not impersonate anyone. You keep ownership of what you post; you give us a limited licence to store and display it inside Mozey so the product can work.

We can remove content and terminate accounts that break these Terms. You can report content and block other players from inside the app, and a block is enforced both ways.


6. Soles

Soles are a virtual in-app currency, and they cannot be bought. Mozey sells nothing. There are no in-app purchases, no subscriptions, and no payment details are ever collected. Soles are earned by playing, by levelling up, by season rewards, and by inviting a friend who joins.

Soles:

Nothing you spend Soles on affects fairness: no item in the shop can change the outcome of a ranked game. Items change how things look or unlock reading material.

If Mozey ever does sell anything, these Terms will be updated before any purchase is offered.


7. What we do not promise

Mozey is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the app will be uninterrupted or error-free, or that step data, game results, or awards will always be accurate or preserved.

We may change, suspend, or discontinue any part of Mozey, including games, Soles, and seasons. Because nothing in Mozey is sold, discontinuing a feature does not entitle you to a refund, because there is nothing to refund.


8. Limitation of liability

To the fullest extent permitted by law, Goodweather Labs LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost opportunities, arising from your use of Mozey. Because Mozey is free, our total liability for any claim relating to it is limited to twenty-five US dollars.

Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits, and nothing here limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be excluded.


9. Ending things

You can stop using Mozey and delete your account at any time. We can suspend or terminate an account that breaks these Terms, creates risk for other players, or must be closed for legal reasons. Sections that by their nature should survive termination do survive it, including Soles having no cash value, the disclaimers, the liability limits, and the governing-law terms.


10. Changes to these Terms

We may update these Terms. If a change is material we will update the "Last updated" date above. The current version is always at https://mozey.app/terms, and the version your account last accepted is recorded when you sign in. Continuing to use Mozey after a change takes effect means you accept it; if you do not, you can delete your account.


11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the courts located in California have jurisdiction, except where mandatory consumer-protection law where you live gives you the right to bring a claim locally, which these Terms do not take away.

There is no arbitration clause and no class-action waiver in these Terms. That is deliberate. You keep every right you would otherwise have to bring a claim, including in small-claims court.
